2014 Medicare Disenrollment Rights and Responsibilities

Generally a beneficiary who chooses to enroll in a Medicare Advantage plan must stay in that plan for the full year. There are some exceptions, though.

Can I be disenrolled from my plan?

You will be disenrolled from Healthfirst Medicare Plan in the following circumstances:

  • If you enroll into another plan, Medicare will notify us and we will update your records and send you confirmation of your disenrollment.  If you did not intend to disenroll from Healthfirst Medicare Plan, you have the right and responsibility to ask us to cancel your disenrollment.  But you must notify us before the last day of the month you are enrolled in our plan.

  • If you live outside of the service area for more than 6 months in a row, we will send you a letter asking for confirmation of your address before we send you notice of your disenrollment.  Medicare requires us to disenroll any member who lives outside of our service area for more than six months at one time.

  • If you move out of the service area permanently, you have a right to enroll in a Medicare Advantage or Prescription Drug Plan in your new community but this option has a time limit.  By enrolling in a new plan, you will be disenrolled from Healthfirst Medicare Plan.  If you do not enroll into another plan during the limited time allowed by your move, you will have to wait until the Annual Enrollment Period (AEP) to choose a new plan or to disenroll from our plan or you will be disenrolled from our plan after six months of living outside our service area.

When can I choose to disenroll from my plan?

You may choose to disenroll from Healthfirst Medicare Plan under the following circumstances:

  • During the Annual Enrollment Period that runs from October 15th through December 7th each year, you may disenroll from Healthfirst Medicare Plan and return to Original Medicare or you may enroll in another Medicare Advantage Plan or Prescription Drug Plan and be disenrolled from our plan.  We will send you confirmation of your disenrollment that will be effective January 1st of the following year.  If you did not intend to disenroll from our plan, you will need to contact us to cancel your disenrollment before the last day of the month when you are scheduled to be disenrolled.

  • During the Medicare Advantage Annual Disenrollment Period that runs from January 1st through February 14th each year, you may disenroll from our plan and return to Original Medicare.  You may do this either by enrolling into a Prescription Drug Plan or by asking us to disenroll you.  The effective date for disenrollment would be end of the month in which you made a completed request.

  • If you are a dual eligible member who has medical assistance from the State or receives Extra Help for Part D drugs from Medicare, you may disenroll at any time.  Your disenrollment would be effective with the start of the new month.  You may choose to disenroll by contacting Healthfirst Medicare Plan in writing – be sure to sign and date your disenrollment request – or by enrolling into another Medicare Advantage or Prescription Drug Plan.

  • If you qualify for other Special Enrollment Periods, when you use that option to enroll into another Medicare Advantage Plan or a Prescription Drug Plan you will automatically be disenrolled from our plan.

Healthfirst Medicare Plan is an HMO plan with a Medicare contract and a contract with the New York Medicaid program. Enrollment in Healthfirst Medicare Plan depends on contract renewal.
